A subcontractor is an independent contractor or business hired by the prime contractor to perform a specific portion of a home improvement job—such as electrical, plumbing, HVAC, flooring, masonry, or other specialized work.
In NYC, subcontractors performing home improvement work must hold their own DCWP Home Improvement Contractor license, unless they are licensed by another agency (e.g., DOB-licensed plumbers or electricians). Subcontractors work under the direction of the prime contractor but operate as separate businesses.
Subcontractors:
Provide specialized labor or expertise
Use their own tools and equipment
Are paid by the prime contractor, not the homeowner
Can file a mechanic’s lien if they are not paid
Must comply with licensing rules and applicable building codes
The prime contractor remains responsible for the subcontractor’s work and for paying them—homeowners are not liable if the prime contractor fails to do so.
