A mechanic’s lien is a legal claim that a contractor, subcontractor, or materials supplier can file against a property when they have performed work or supplied materials but haven’t been paid. It creates a financial hold on the property, making it difficult for the owner to sell or refinance until the debt is resolved.
In NYC home improvement work, every contract must warn the homeowner that unpaid contractors or subcontractors may file a mechanic’s lien against the property. If the homeowner already paid the contractor before the lien was filed, the lien can often be discharged through the courts. Homeowners may need legal assistance to remove an improper or disputed lien.
